Grisedale Croft Care Home: building expenditure figures, condition reports and maintenance plans (refined resubmission of FOI-211351-2026)

A refined resubmission of FOI-211351-2026, narrowed after Westmorland and Furness Council's section 12 (cost limit) refusal of 2 June 2026. It asks only for recorded building expenditure figures and a finite, named set of documents (condition reports and maintenance plans), with each item severable and section 16 advice requested on anything over the cost limit. Correspondence

  1. · Partial response Received

Cumberland Council gave a partial response on 13 May 2026 under reference FOI-215087-2026. It signposted published material under section 21 of the Act for question 2 (the 15 December 2020 Health Scrutiny Committee minutes), confirmed that questions 3 and 4 were not held, and asked the Working Group to confirm whether it wished the council to proceed with question 1 given a possible overlap with the Westmorland and Furness Council response then awaited.

  2. · Clarification request Sent

This is our response to their response Reference: FOI-215087-2026 Dear Information Governance Team, Thank you for your response of 13 May 2026 to my request of 24 April 2026. In respect of Question 1, I confirm I would like Cumberland Council to proceed with the disclosure of any records held that were inherited from Cumbria County Council concerning the 2017–18 closure of the Alston in-patient beds at the Ruth Lancaster James Cottage Hospital, or concerning the Alston Alliance / Eden Integrated Care Community plan. I am content to receive material even where there is some overlap with material that may subsequently be disclosed by Westmorland and Furness Council under FOI-208440-2026 (whose statutory deadline is 22 May 2026). My reasons are briefly: (i) the response from Westmorland and Furness Council has not yet been received, so duplication cannot be assumed; (ii) the disaggregation of former Cumbria County Council records between the two successor authorities is, as I understand it, still in progress, and the two councils may hold different parts of the archive; and (iii) where the same record is held by both bodies, the cross-reference is itself useful as confirmation. I would be grateful if you could confirm the revised statutory deadline for the disclosure on Question 1. I am content with your responses to Questions 2 (Section 21 referral — noted, with thanks for the URL to the 15 December 2020 Health Scrutiny Committee minutes), 3 (information not held), and 4 (no placements made by Cumberland Council at Grisedale Croft since the local government reorganisation, and no records held to the requested level of detail prior to 1 April 2023).

  3. · Full response Received

Cumberland Council completed its response on 10 June 2026 under reference FOI-216974-2026, disclosing the minutes of the Special Cumbria Health Scrutiny Committee for 2016 to 2018 in answer to question 1. Those minutes include the Committee's record of 22 March 2017 that the medical beds would not close until alternative models were in place. Question 2 was met by signposting published material under section 21 of the Act, and questions 3 and 4 were confirmed as not held.

  1. · Acknowledgement Received

The ICB acknowledged the request under reference FOI ICB 26-033 and confirmed a statutory deadline of 22 May 2026.

  2. · Full response Received

The ICB stated, under section 1(1) of the Act, that it does not hold any of the information requested, that the information is held by North Cumbria Integrated Care NHS Foundation Trust, and signposted the Trust's FOI contact.

  3. · Internal review outcome Received

The ICB upheld its original response, stating that the All Age Continuing Care Team and the Head of Commissioning for Secondary Care had searched and held no records, and signposting NHS England for any Success Regime or Sustainability and Transformation Partnership records.

  4. · Other correspondence Sent

The Working Group asked the ICB to confirm the detail of its searches before any application to the Information Commissioner, in particular whether the legacy Clinical Commissioning Group records, named officer mailboxes and specific reporting streams had been searched.

  5. · Other correspondence Received

The ICB reiterated that it holds no records, adding that the Deputy Director Neighbourhood North had checked and found none, and that the Information Governance team had searched the archived former Clinical Commissioning Group website on the National Archives for ‘Grisedale’ and ‘Alston’ and found none.

  6. · Other correspondence Sent

The Working Group referred the request to the Information Commissioner under section 50 of the Act, the ICB's internal review process having been exhausted; the Commissioner has acknowledged the complaint and opened a case under reference IC-524832-R7F0.

  7. · Other correspondence Sent

The Working Group added supplementary evidence to the Information Commissioner on 21 June 2026 - the signed service level agreement for the beds and the Cumbria Health Scrutiny Committee minute of 22 March 2017 - both of which bear on the matters in dispute.

The Trust advised it could not respond within the statutory 20 working days and required further time to identify and locate the information requested.

  2. · Other correspondence Sent

The Working Group confirmed it was content to allow the additional time needed for a comprehensive response rather than a partial one provided to meet the deadline.

  3. · Chase letter Sent

The Working Group asked for an update on progress and an indication of the date by which the response would be provided.

  4. · Full response Received

North Cumbria Integrated Care NHS Foundation Trust released the Alston Plan 2017-2020 and the operational documents under which Grisedale Croft was used as NHS-funded step-up and step-down beds for Alston Moor residents, including the written admission criteria, and confirmed that these processes remain in place. It also released, for transparency, the 2017-2018 Success Regime Private Board papers connected to the closure of the in-patient beds at the Ruth Lancaster James Cottage Hospital. Discharge records for Alston Moor residents leaving the Cumberland Infirmary show no discharges to bedded rehabilitation (Pathway 2) in any year from 2021/22 to 2025/26, and the Trust holds no correspondence with Westmorland and Furness Council or Cumberland Council since January 2025 about Grisedale Croft or step-down provision on Alston Moor.

  3. · Refusal Received

The Trust responded under reference 10893, refusing question 1 under section 40(2) of the Act on the basis that individuals in a small area could be indirectly identified, and stating that the information sought in the remaining questions was not held, signposting the questions about the Ruth Lancaster James Cottage Hospital to North Cumbria Integrated Care NHS Foundation Trust.

  4. · Internal review requested Sent

The Working Group requested an internal review, asking the Trust to release the discharge figures with small-number suppression rather than refusing them outright, to provide the activity data or confirm there has been no in-patient activity at the Ruth Lancaster James site, to provide a current description of the services it operates from that site, to confirm whether it holds a general discharge and patient-choice protocol, and to confirm the scope of its searches.

Correspondence

  1. · Full response Received

NHS England confirmed it holds some information, stated that the commitments and the monitoring of the Success Regime changes would have been made or undertaken by North Cumbria CCG as commissioner, found no records of correspondence with the provider trust concerning the Alston Alliance / Eden Integrated Care Community, and directed the Working Group to the Integrated Care Board and the Trust.

  2. · Internal review requested Sent

The Working Group requested an internal review, asking NHS England to confirm what it holds within questions 1 and 2 and to confirm or extend its search to legacy regional and national records, and noting that the response to question 3 addressed the provider trust rather than the commissioner and omitted the question's second limb.

  3. · Other correspondence Sent

The Trust acknowledged receipt, noted that requests may be handled through its optional online portal, and confirmed the response could be delivered by email or via the portal.

  2. · Other correspondence Sent

The Working Group asked that the request be handled and answered by email rather than through the portal, consistent with the Trust's handling of the earlier 24 April request.

  3. · Acknowledgement Received

The Trust confirmed the request had been logged under reference FOI 0000 6883 and that it would respond within 20 working days by email.

  4. · Chase letter Sent

The Working Group noted that the 20 working day period had passed and asked the Trust to provide its response or a date by which it would be provided.

  5. · Partial response Received

This request followed the North East and North Cumbria Integrated Care Board directing the Working Group to NCIC, on the basis that the Trust held the step-down and Discharge to Assess (Pathway 2) information. NCIC confirmed that Grisedale Croft was not on the Trust's formal list of commissioned Pathway 2 bedded settings, and that records of any commissioning or placement arrangement for the beds should be sought from the Integrated Care Board. The Integrated Care Board had already stated, under reference FOI ICB 26-033, that it held no such records. NCIC also confirmed it holds no discharge policy specific to Alston Moor, and no internal discussion since January 2025 about the implications of any change to provision in Alston. On the question of how the beds were commissioned, the two NHS bodies each point to the other, and neither holds a record. Question 1 was withheld under section 40(2) of the Act.

Correspondence

  1. · Clarification sent Sent

The Working Group wrote to distinguish this request from a related request of the previous day, confirming that the question common to both — correspondence since 1 January 2025 concerning Grisedale Croft and step-down provision — should be answered once under the related request, and that the remaining questions were not duplicative.

  2. · Acknowledgement Received

NHS England confirmed receipt and assigned reference FOI-2604-2323728, to be answered within 20 working days.

  3. · Full response Received

NHS England stated that it does not hold the requested information, that searches had been carried out in its North East and Yorkshire region, and that the information may be held by the Integrated Care Board, to which it directed the Working Group.

  4. · Internal review requested Sent

The Working Group requested an internal review, asking NHS England to extend its search beyond the current North East and Yorkshire systems to its legacy ‘North of England’ regional records, covering the North East and North West including Cumbria, and to central and national Programme Board records, before a ‘not held’ conclusion was confirmed.

  5. · Acknowledgement Received

NHS England acknowledged the internal review request, indicating that internal reviews are handled within 20 working days and may on occasion extend to 40.

  6. · Other correspondence Sent

The Working Group supplemented its internal review on 21 June 2026, noting that the request had named the Alston Plan, which has since been disclosed by North Cumbria Integrated Care NHS Foundation Trust, contradicting the 'not held' search.

Correspondence

  1. · Clarification request Sent

Dear Information and Case Management team, We are writing to follow up on my message of 28 April 2026, sent under reference FOI-208440-2026, in which we asked the Council to confirm that each of the five distinct subject areas would receive a substantive response, and invited contact before any formal refusal under section 12 if scope needed to be discussed. We have not yet received a reply to that message. As the response date of 22 May is now ten days away, we would be grateful for a brief acknowledgement confirming whether the Council has had the opportunity to consider the points raised. The request

Concerns the cost figures in the consultation "The future of Grisedale Croft Care Home" (open 14 May to 5 August 2026), which states refurbishment would need an estimated £2.5 million to £3.0 million to meet modern regulatory standards (Option 2), described as indicative costs based on similar council projects in Cumbria. The request asks for the recorded basis of those refurbishment and rebuild figures.
